Dispute Summary

Prior to seeking a permit, xAI installed 35 “temporary” gas turbines to power the company’s Colossus facility. After community contestation, CTC Property LLC submitted an application on behalf of xAI to the Shelby County Health Department (SCHD) and were granted permit to operate 15 permanent turbines. The Southern Environmental Law Center (SELC), representing the NACCP, appealed the permit and threatened suit against xAI. SELC contests these turbines on the grounds that they are in violation of the Clean Air Act and local pollution regulations. A lawsuit has not yet been filed and the dispute is ongoing.

  • December 15, 2025 Shelby County Air Pollution Control Board dismisses SELC appeal of xAI's gas turbine permit. The vote was 6-1.
